Estate Planning and Administration.

At TimberlakeSmith, we help individuals and families meet their estate planning needs while also considering the many issues that surround an estate plan. We understand how important family and business legacies are, and we are able to offer personalized attention and recommend customized solutions to address all of a client's needs while minimizing expenses, costs and taxes.

Our services include the development of wills, advice on estate and income tax planning, advice on retirement plans and Individual Retirement Accounts (IRAs), and the analysis of asset valuations for estate and gift tax purposes. We establish family limited partnerships, limited liability companies, charitable trusts, real estate trusts, special needs trusts and revocable and irrevocable trusts. We also have extensive experience drafting and advising on the use of powers of attorney, advance medical directives (also known as living wills) and health care powers of attorney.

We represent people and institutions who perform the duties of executor, administrator, trustee, conservator, guardian or any other fiduciary capacity and help them fulfill their obligations. We assist with all court and governmental filings with local clerks and commissioners of accounts. Working with accountants for an estate, we also assist with federal and state tax issues related to an estate’s administration.

Whatever a client's needs, our experience in this area of the law helps us to give guidance and advice across the full range of this area of the law: from clients who either are considering an estate plan for the first time all the way to those experienced clients who find themselves administering an estate or performing fiduciary duties.
